My husband and I made an offer on a foreclosure property. After submitting our offer the realtor told us we had been out-bid by a small amount. He discouraged us from continuing to bid. 6 months later we have come to find out that the realtor/ listing agency bought the property. This is the same exact realtor that submitted our offer and advised us to give up. They used our bid to make their look good. They are also the agency that initially set the price on the home. Is this legal? Would it be worthwhile to contact the owner of the home (a lending agency)?
Please document everything you can, and file complaints with the board of realtors, and commerce department or whichever agency regulates real estate in your area.
That agent can and should be fined, lose their license, etc… If nothing else, you will create a record that will show every time something else they do comes in, and eventually they’ll be out of a career.
Without your help, this scumbag will continue to exploit their position and screw over the public. Don’t wait, just get it done.

how much of that 6 percent goes to their boss, say ReMax, Coldwell Banker, etc? What if they split the commission 3% with another realator. What would that realtors brokerage firm get?
The brokerage firm typically gets 50% of all the money their agents make – regardless of the breakdown as sellers agent, buyers agent, or dual agent. It’s also not unusual for newbies to have to pay additional fees to their broker in addition to the 50% such as document storage fees, advertising fees, rent, etc. But everything in real estate is negotiable and experienced top producers can usually negotiate lower fees to their broker.

Add Details: We have experienced extreme non-performance from the realtor: lack of due diligence, poor communication and lack of attention to details. Result: Requested Termination of Listing for cause and rec’d written release from the broker with an apology. Moral: You don’t have to put up with poor service – Listing contracts can and should be broken for cause
Previous post is correct, there is an expiration date on the listing. Contracts can be voided for only a few reason (death, nonfulfillment, nonperformance, etc). When in doubt, consult a lawyer.

Two months ago, our Realtor took us to see a home in Mass. Our offer was accepted and we went through the inspection. We asked the sellers to repair one minor issue. Our Realtor came back to us reporting that the listing agent said the couple were insulted at our request and no longer wanted to sell. Weeks later, after writing an email to the sellers explaining that we loved the house, we received a phone call directly from the sellers, telling us that the inspection was never the issue. They said they were planning to purchase another home, the sale fell through, and they couldn’t sell their home yet. To date, we have still never been told about the issue by the listing agent.
We think it’s probable that the listing agent (a REALTOR) did not tell us about the issue because she believed we’d go look at another property and she’d lose the sale.
Knowing that Realtors © are required to go by a code of ethics, do we have the right to file a complaint about her unethical behavior?
We have the sellers’ statements in writing.
You can file a complaint, but the chances are good that it won’t result in anything. In order to get anywhere, you’re going to need those sellers to verify what they told you IN WRITING. The odds of that occurring are very slim, since this woman is working to sell THEIR house.
As well, how do you know that it’s not the SELLERS who are not telling the truth about this ? After nearly two decades in real estate, NOTHING out of the mouths of buyers or sellers surprises me anymore.
Follow up: If you have the sellers on paper to that effect, go for it. It’s rare for sellers (or buyers) to do that, but apparently these folks have agreed to do so. Start with the managing broker of the firm involved, and then work your way ‘up the ladder’.

Hi, the listing said that cable was included in monthly assessment. Now I just found out that cable is NOT included. This makes me very angry… My closing is soon. Is there anything I can do to make the seller/listing agent give me a credit?
This is not a huge deal. What are you talking about? $40 a month. You WERE!!! given the HOA docs that clearly outlined what was included. And I’m sure you read them. So why didn’t you find out this mistake?
